Buwis sa e-sabong, isinusulong ng senado

Naghain si Senate President Pro Tempore Ralph Recto ng panukalang batas na magpapataw ng buwis sa mga lisensyadong online sabong at derby.

Layon ng Senate Bill No. 2045 na amyendahan ang National Internal Revenue Code (NIRC) ng 1997 upang isama ang pagpapataw ng 18-porsyento na tax para sa amusement sa digital platform at mga offsite na istasyon ng pagtaya ng mga lisensyadong sabungan.


Kasalukuyang nagbabayad 18% na amusement tax ang mga sabungan base sa kanilang gross receipts, subalit ayon sa explanatory note ng panukalang batas ni Recto, kailangang isaalang-alang kung saklaw ba ang mga sinasabing digital economic activities gaya ng pagtaya sa mga sabong at derby sa pamamagitan ng online o digital platform o “e-sabong” ng umiiral na tax laws ng bansa.

Giit pa ng senador, “A law will not be construed as imposing a tax unless it does so dearly and expressly. In case of doubt, tax laws must be construed strictly against the government and in favor of the taxpayer.”

“(To) remove any ambiguity or avoid the confusion whether or not this particular digital economic activity known as ‘e-sabong’ is taxable In our jurisdiction,” pagbibigay diin ni Recto kung bakit umano kailangang patawan ng buwis ang mga digital plat forms at offsite betting stations ng mga awtorisadong sabungan.

Sa panukalang batas ni Recto, itatalaga ang kabuuang kita na makukolekta mula sa amusement tax sa mga sabungan para sa universal health care.

Mapupunta ang 20% sa buong bansa “based on the political and district-subdivisions, for medical assistance, the health facilities enhancement program, the annual requirements of which shall be determined by the Department of Health.”

Ilalaan naman ang 80% sa Philippine Health Insurance Corp. (PhilHealth) para sa pagpapatupad ng Universal Health Care (UHC) Act.
