November 18, 2003 nang ipahayag ng Massachusetts Supreme Court na ang pagbabawal sa same-sex marriage ay unconstitutional. Hindi umano maaaring ipagkait ng estado ang proteksyon, benepisyo at obligasyong ipinagkaloob ng kasal sa same-sex partners na nais magpakasal.
